Terms and Conditions for Event Organisers

General

Air acts as an agent for Event Organisers (‘you’); any agreements brokered by Air for the sale of your tickets are between you and the purchaser.

In listing an event on Air´s website (the ‘Site’), or offering tickets for sale, you agree to be bound by these Terms and Conditions and all applicable laws and regulations governing the Site.

Air reserves the right, at its sole discretion, to de-register Event Organisers and de-list events.

Air will try to give three months´ notice of any change these Terms and Conditions by a notice on the Site, but reserves the right to change them at any time, effective immediately upon posting on the Site.

Air´s ticket-purchasing process is described in the Terms and Conditions for online purchasers, also on the Site; you may want to check them before reading on.

Selling tickets on the Site

Air offers a free online What´s On service to Event Organisers promoting artistic events in Richmondshire and neighboring districts; to list an event, first register as an Event Organiser on the Site, then follow the online instructions. Once you have listed an event, you may also offer the tickets for sale on the Site; this is not a free service.

Ticket allocation

When you allocate a quantity of tickets to Air, ensure you do not double-sell them. (You may find it useful to set aside the same quantity of physical tickets.) If you need more tickets for your own box office, or want to allocate more to Air, simply amend the quantities in your event entry on the Site.

Email confirmation

Every time a ticket-selling transaction is closed, Air will send a confirmation email to the purchaser, copied to you, with details of the tickets sold in the transaction, the monies received, and basic purchaser information. This:

Event Organisers who are offering tickets for sale through Air may also check purchaser details and ticket sales on the Site.

Financial

When you first place tickets for sale on the Site, Air will contact you for your bank details. Air will receive payments from purchasers and remit them to your designated bank account fortnightly, minus a charge for each ticket sold. The standard ticket charge is £0.75.

Cancellation and rescheduling

If you cancel or reschedule an event, you must use all reasonable endeavours to contact purchasers. Air will remit to you all monies received from purchasers, net of ticket charges, and it is your responsibility to make refunds to customers if appropriate.

Reports

Air expects in due course to be able to offer Event Organisers a range of summary reports.

Air will only pass on personalised purchaser data to Event Organisers if so authorised by individual purchasers, on payment of an agreed processing fee, and on the understanding that you will use such data only as allowed by the Data Protection Act (1998).

Disclaimer

Air does not warrant that the Site will be error-free, uninterrupted, or that it will provide specific results from the use of the Site or any content on it. The Site and its content are delivered on an "as is" and "as available" basis.

Air will take all reasonable precautions to keep the Site free of viruses and other destructive features, but cannot guarantee that this will always be the case. Site Content, therefore, is downloaded at your own risk.

Air disclaims all warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.

Air will not be liable for any damages arising from the use of the Site, including without limitation direct, indirect, incidental, and punitive and consequential damages.

Air disclaims any and all liability for the acts, omissions and conduct of any purchasers, third-party users, advertisers and/or sponsors on the Site in connection with the Site or your use of it.

Air is not responsible for the products, services, actions or failure to act of any Event Organiser, performer or other third party in connection with or referenced on the Site.

Limitation of Liability

In no event will Air be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, or for loss of profits, revenues or business opportunities.

Indemnity

You agree to indemnify and hold Air and its officers, agents, employees and contractors harmless from any loss, liability, claim or demand, including reasonable legal expenses, made by any third party due to or arising out of your use of the Site.
